A Connecticut family was recently awarded a $58 million verdict in a cerebral palsy birth injury lawsuit. The verdict has been reported to be the largest verdict ever given by a Connecticut jury.
The family filed the lawsuit because their son suffered brain damage and developed cerebral palsy due to a doctor’s failure to order a C-section when his mother was in labor. The mother went into labor in February 2003 and soon after the amniotic fluid levels showed significant drops. This should have told doctors to order an emergency C-section. However, doctors waited to order the C-section and as a result the infant suffered multiple birth injuries.
$8 million of the verdict was designated to the boy’s future medical expenses related to his cerebral palsy and the other $50 million was for emotional and physical trauma.
