Last month, a birth injury lawsuit in Michigan resulted in one of the largest verdicts for a case involving cerebral palsy in the history of the U.S.
The lawsuit was filed against Beaumont Hospital and a doctor at the hospital. In the case heard in Oakland County Circuit Court, the mother of a 15-year old girl with cerebral palsy argued that her daughter developed the condition as a result of brain damage caused by the hospital’s failure to call for a C-section delivery.
When the girl was born, she weighed 10 pounds and 12 ounces. The suit claimed that the doctor should have realized that a C-section was necessary due to the child’s large size. Furthermore, the doctor’s failure to call for a C-section caused the child to suffer a fracture to her clavicle, multiple hemorrhages, and permanent brain damage.
The jury found the hospital negligent and issued a $144 million verdict. The award will allow the girl’s family to pay for her round-the-clock care for about 77 years.
