Under comparative negligence, an injured individual cannot collect compensation if their mistakes were the major cause for the accident. This is determined according to percent of blame, meaning that anyone bearing more than 50 percent of fault for the accident cannot claim compensation. Otherwise, amounts are given according to the individual’s level of fault.
