Judge denies custody to mother because of cancer diagnosis

Recently, a North Carolina judge awarded custody of two children to their father in large part due to the fact that their mother has stage 4 breast cancer.  The 37-year old mother was diagnosed with the cancer in 2007, but has been able to keep it stable through monthly treatments.

Both children, ages 6 and 11-years old, lived with their mother in Durham, North Carolina.  However, the decision requires both to move in with their father, who lives just outside of Chicago, in July.  The mother plans to appeal the child custody decision.

Online petitions and support groups have been created to encourage the mother’s appeal.
