Jury awards $2.3 million in slip-and-fall case against Kroger

A jury in Georgia recently awarded the victim of a slip-and-fall accident at a Kroger grocery store $2.3 million.  According to the lawsuit, the plaintiff, 49, was injured in May 2008 when he slipped on a pile of crushed fruit that had spilled on the floor.

When the plaintiff fell, he seriously injured his spinal cord.  Surgery to repair the injury involved stabilizing the spinal cord with several screws and rods.  The man’s medical bills amounted to $135,000.  In addition, he was unable to continue working as a commercial landscaper after the accident.

Kroger claimed that video cameras at the store did not cover the area of the store where the man slipped.  Moreover, the store’s manager claimed that tapes from the day the accident occurred had been taped over because the store’s policy only requires videos to be kept for 17 days.

The plaintiff’s lawyers went to the store for a demonstration of their video camera system, only to find that one of the store’s cameras was pointed directly at the location where the plaintiff had slipped.  The judge in the case determined that Kroger had destroyed evidence.
