Understanding the Four Elements
In order for a tort to have been committed, four elements all must be in place. Unless all four are present, you may not have a case. The elements are:
- The presence of a duty. Duty can be defined as simply as “an obligation to behave in an appropriate way.” A driver on the road has a duty to drive safely so as to avoid an accident.
- The breach of a duty. The defendant failed to live up to his or her duty. In the previous example, a driver may breach his or her duty by driving recklessly.
- An injury occurred. You must have been injured in some manner.
- Proximate cause. The injury must have been caused by the breach of duty. For example, you have been injured in a car accident caused by a reckless driver.
