$10 million slip and fall verdict upheld

Today, the Colorado Supreme Court upheld one of the largest slip and fall lawsuit verdicts in the history of the country.

The lawsuit was filed by a 41-year old truck driver after she slipped on a 185-foot spill of grease while making a delivery at a Walmart store in December 2007.  Investigators determined that the grease had been sitting on a truck ramp in the parking lot for 7 days before the woman slipped and injured herself.

After the accident, the truck driver had two back surgeries and a neck surgery and was no longer able to work.  The victim’s medical bills from the injuries she suffered in the accident totaled around $500,000.

Last year, a jury awarded the woman $15 million, but the award was reduced to $10 million due to the state’s limit on awards for non-economic damages.  With today’s ruling, an appeal from Walmart was overturned and the victim will receive the $10 million awarded in the original case.
