Recently, a claimant was awarded $12 million for insurance bad faith on the part of Progressive Insurance.
The lawsuit involved a driver who was insured with Progressive and was the victim of a rollover accident a few years ago. A passenger in the vehicle was killed in the accident and 5 others incurred serious injuries.
Initially, a judge in New Mexico dismissed the bad faith denial of insurance coverage claim against Progressive because the driver’s insurance coverage was technically expired at the time of the accident, according to the wording of the driver’s insurance policy.
However, the case was appealed and the Court of Appeals found evidence beyond the language of the driver’s policy in conversations with insurance agents and notices from the insurance provider that the policy was still in place at the time of the accident.
